Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you" or "your") and Dynamica Soft Sistemas Ltda, a private limited company incorporated under Brazilian law, registered under CNPJ 15.110.085/0001-38, with its principal place of business in Brazil ("Dynamica Soft", "we", "us" or "our"), governing your access to and use of the website located at dynamicasoft.site, along with any associated subdomains, pages, applications, services, tools, content and communications made available by Dynamica Soft (collectively, the "Website").

The Dynamica Soft name, logo and all product or service names associated with the Website are trademarks or service marks of Dynamica Soft. You may not use these marks in any manner that is likely to cause confusion among consumers, disparage or discredit Dynamica Soft, or that is otherwise unlawful, without our express written permission.

You are strictly prohibited from:

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In those cases, Dynamica Soft's liability will be limited to the maximum extent permitted by applicable law. This limitation of liability constitutes an essential element of the basis of the agreement between you and Dynamica Soft.

Indemnification

You agree to defend, indemnify and hold harmless Dynamica Soft Sistemas Ltda and its directors, officers, employees, contractors, agents, partners, licensors and successors from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, costs and expenses (including reasonable legal and attorney fees) arising out of or relating to:

Governing Law and Jurisdiction

These Terms, and any dispute, controversy or claim arising out of or relating to these Terms, to your use of the Website, or to the existence, breach, termination, enforcement, interpretation or validity thereof, shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict-of-law principles.

The parties expressly elect the courts of the judicial district of the city where Dynamica Soft maintains its registered office in Brazil as having exclusive jurisdiction to resolve any dispute arising out of these Terms, waiving any other venue to which they might otherwise be entitled by reason of their current or future domicile or for any other reason.

Notwithstanding the foregoing, Dynamica Soft reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of its intellectual property rights, confidential information or other proprietary rights, without the need to post a bond or other security.

Changes to These Terms

Dynamica Soft reserves the right to revise, amend or replace any part of these Terms at any time, at our sole discretion and without prior notice. Changes may be made to reflect updates in our services, changes in applicable law, new regulatory requirements, or to improve clarity and accuracy. All changes become effective immediately upon publication of the revised Terms on the Website.
